General Terms and Conditions – Claudia Stapel

Article 1. Definitions

1.1 General Terms and Conditions: these terms and conditions.

1.2 Entrepreneur: Claudia Stapel, operating under Claudiastapelart.com , including any legal successors.

1.3 Customer: any natural person or legal entity entering into an agreement with the entrepreneur.

1.4 Agreement: any agreement between the entrepreneur and the customer, including these terms.

1.5 Product: any physical item supplied by the entrepreneur, including art materials and artworks.

1.6 Service: any service provided by the entrepreneur, including workshops, courses, and coaching.

1.7 Digital Content: any content supplied in digital form, including online courses, videos, or downloads.

1.8 Right of Withdrawal: the customer’s legal right to cancel a distance agreement within the cooling-off period.

1.9 Cooling-off Period: 14 days from receipt of the product.

Article 3. Applicability

3.1 These terms apply to all offers, agreements, and deliveries.

3.2 Deviations are only valid if agreed in writing.


Article 4. Offers

4.1 All offers are non-binding.

4.2 Obvious errors do not bind the entrepreneur.

4.3 Images and colors are indicative only.


Article 5. Agreement

5.1 The agreement is concluded upon acceptance and payment.

5.2 The entrepreneur may refuse orders or attach conditions.


Article 6. Prices and Payment

6.1 All prices include VAT unless stated otherwise.

6.2 Payment must be completed via the offered payment methods.

6.3 The entrepreneur may suspend delivery in case of non-payment.


Article 7. Delivery

7.1 Delivery takes place at the provided address.

7.2 Delivery times are indicative (max. 30 days unless agreed otherwise).

7.3 Risk transfers upon delivery.


Article 8. Right of Withdrawal (Physical Products)

8.1 The customer may withdraw within 14 days of receipt.

8.2 Products must be returned unused and in original condition.

8.3 Return shipping costs are borne by the customer.

8.4 Refunds are issued within 14 days after return.


Article 9. Exclusion of Withdrawal Rights

The right of withdrawal does not apply to:

  • Custom-made artworks
  • Personalized products
  • Opened sealed items (for hygiene reasons)
  • Digital content once access has started
  • Workshops or events booked for a specific date

Article 10. Workshops, Courses & Coaching

10.1 Bookings are binding.

10.2 Cancellation by the customer:

  • Up to 14 days before: full refund
  • Within 14 days: no refund (unless otherwise agreed)

10.3 The entrepreneur may reschedule or cancel if necessary.


Article 11. Digital Content

11.1 Access to digital products may start immediately after purchase.

11.2 By purchasing, the customer agrees to waive the right of withdrawal once access is granted.

11.3 Digital content may not be shared, copied, or distributed.


Article 12. Intellectual Property

12.1 All artworks, materials, and content remain the intellectual property of the entrepreneur.

12.2 They may not be reproduced or used commercially without permission.


Article 13. Complaints

13.1 Complaints must be reported within a reasonable time after discovery.


Article 14. Liability

14.1 The entrepreneur is not liable for indirect damages.

14.2 Liability is limited to the purchase amount of the product or service.


Article 15. Force Majeure

15.1 The entrepreneur is not liable for delays or failures caused by force majeure.


Article 16. Privacy & Right to be Forgotten

16.1 The customer may request deletion of personal data at any time.


Article 17. Applicable Law

17.1 Dutch law applies to all agreements.
